These Terms of Service (“Terms”) govern your use of TrackToGrow (the “Service”). By creating an account or using the Service, you agree to these Terms.
If you use TrackToGrow on behalf of a company, you confirm you have authority to bind that company.
1. Service scope
TrackToGrow provides a workspace and workflow for creating, managing, and sharing monthly client updates.
TrackToGrow helps agencies turn performance data into structured client updates, but you remain responsible for the accuracy of the underlying data sources you use.
2. Eligibility
You must be able to form a legally binding contract to use TrackToGrow. If you’re using the Service on behalf of a company or agency, you confirm you’re authorized to act for them and to enter into these Terms on their behalf.
3. Accounts and security
You are responsible for:
- keeping account credentials and API keys secure;
- rotating keys if exposed;
- limiting access to authorized users;
- activity under your workspace.
If you suspect unauthorized access, contact us promptly through our contact page.
4. Bring-your-own provider credentials
If you connect SMTP or provider API credentials:
- you confirm you have rights to use any connected integrations, source data, and client materials;
- you are responsible for permissions, setup, and any third-party charges tied to those systems.
We may disable configurations that present abuse, security, or operational risk.
5. Usage limits and quotas
Plan limits are enforced per billing period and may include client, user, and AI narrative credit quotas. Unused quota does not roll over unless explicitly stated in your plan.
6. Acceptable use
You agree not to use TrackToGrow to:
- send unlawful, abusive, deceptive, or unsolicited content;
- violate anti-spam or privacy laws;
- deliver malware, phishing, or harmful payloads;
- attempt to bypass plan or security controls;
- interfere with service operation.
We may block or restrict traffic, domains, or configurations that create abuse or compliance risk.
7. Intellectual property
TrackToGrow owns the Service, including its software, design, and branding. These Terms don’t transfer any of that to you — you get a limited, non-exclusive right to use the Service for your own reporting workflow while your account is active.
You own the data you enter or import (your client workspaces, metrics, narratives, and reports). You can export it at any time from within the Service, and you’re free to do whatever you like with your own exported data.
8. No professional advice
TrackToGrow is a reporting and workflow tool. It is not marketing, financial, legal, or business advice, and using it does not create a professional relationship of any kind. You’re responsible for the accuracy of the data you enter and for the decisions you or your clients make based on reports generated using the Service.
9. Billing, payment, and cancellation
If you subscribe to a paid plan:
- Fees: Prices are listed on our website and may change with notice.
- Billing: Subscriptions are billed in advance and renew automatically until canceled.
- Upgrades: Plan upgrades may apply immediately.
- Downgrades: Plan downgrades typically take effect at the next billing cycle.
- Refunds: Payments are non-refundable once a billing period starts, except where required by applicable law. Use the Free plan to evaluate TrackToGrow with your own data before upgrading — there’s no trial period and no credit card required for the Free plan.
- Cancellation: You may cancel anytime; access continues through the billing period already paid for. Amounts already paid are not refunded.
- Taxes may apply based on your jurisdiction.
10. Suspension and termination
We may suspend or terminate access if:
- you violate these Terms;
- your usage creates legal, security, or operational risk;
- required fees are unpaid.
You may cancel at any time. Cancellation takes effect according to your current billing cycle.
11. Privacy
Your use of TrackToGrow is also governed by our Privacy Policy.
12. Disclaimers
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, or successful delivery in every case.
13. Indemnification
You agree to indemnify and hold TrackToGrow harmless from claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, the data you upload or enter, or your violation of these Terms.
14. Limitation of liability
To the maximum extent permitted by law, TrackToGrow is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability arising from these Terms or your use of the Service is limited to the fees you paid us in the 12 months before the claim arose.
15. Governing law and disputes
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. If a disagreement comes up, we’ll try to resolve it informally first by contacting each other directly. If that doesn’t work, any dispute will be handled by the courts of Ontario.
16. General provisions
If any part of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn’t a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
17. Changes to these Terms
We may update these Terms from time to time. Continued use after changes become effective means you accept the updated Terms.
